"PLASTIC FREE FOR THE SEA" PROMOTION

TERMS AND CONDITIONS


1. Information on how to enter forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

 

Who Can Enter

2. Entry is open to residents of Australia aged 18 years or over

3. Employees (and their immediate families) of the Promoter, Participating Stores and agencies associated with this promotion are ineligible to claim. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

 

How to Enter

4. The promotion opens for registration on Wednesday 20th October 2021 and ends at 11:59pm AEDST on Friday 5th November 2021 (Registration Period).

5. To enter, individuals must, during the Registration Period,

  • Visit praisesustainability.com.au;
  • follow the prompts to the registration page;
  • input the requested details including their full name, email address, mobile number and date of birth;
  • Tick the box to confirm they have read the terms and conditions; and
  • Tick the box to confirm they are eligible based on government vaccination rules at that time.

 

Registration

6. Only one Registration per person. Additional Registrations will not be accepted by the Promoter.

7. Successful winners will be notified by email at the email address provided at registration.

 

Prizes

8.The Prize is 4 x tickets to Plastic Free for The Sea (The Event)

9. There are 10 Prizes to be won.

10. Each Prize is valued at [$800]. The total value of the prize pool is $8000

11. A pick-up location will be notified to winners prior to the Event. The pick-up location is the location from which winners will be collected by water taxi and ferried out to the event site (The Island). Winners will also be ferried back to the same location after the event. Travel to and from the Event pick up location is at the cost of the attendees.

 

How will winners be selected

12. Winners will be selected at 11am on Monday 8th November at Level 3, 118 Talavera Road, Macquarie Park, NSW 2113, Australia by a member of the Praise Marketing Team. This is a game of skill and the most creative answers to our question (Tell us in one sentence why sustainability is important to you?) will be selected.

 

Notification of Winners

13. Winners will be notified on or before Wednesday 10th November at 10am (Win Notification)

14. Winners must confirm their attendance at the event within 48 hours of the date of Win Notification from the Promotor. Failure by a Winner to confirm their attendance within 48 hours of the date of the Win Notification will result in the Winner forfeiting their place at the Event and a new winner will be chosen.

 

Attendance at Event

15. Successful winners will be required to show proof of ID at arrival, along with proof of their full vaccination certificate. Failure to provide proof of ID and Proof of vaccination will result in the Winner being denied entry from the Event.

 

Promoter Rights

16. The Promoter reserves the right, at any time, to verify the details of the selected winner and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, is not over the age of 18, or who has engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

17. Incomplete or indecipherable entries will be deemed invalid.

18. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.

19. The Promoter’s decision is final and no correspondence will be entered into.

20. Claimants consent to the Promoter using their name, likeness, image and/or voice in the event they are a successful claimant (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

21. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

22. Any cost associated with the Plastic Free For the Sea website and/or entry is the claimant's responsibility and is dependent on the Internet service provider used. The use of any automated software or any other mechanical or electronic means that allows a claimant to automatically enter repeatedly is prohibited and will render all claims submitted on behalf of that claimant invalid.

23. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).

24. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury, property damage, or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of or in connection with: (a) registration to the Event, acceptance of the Prize and/or attendance at the Event, (b) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (c) any theft, unauthorised access or third party interference; (d) any claim or Repayment claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (e) any tax liability incurred by a claimant; or (f) taking of a Repayment.

25. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at goodmanfielder.com/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
